Introduction

These Terms & Conditions govern the use of this website and all commissions, purchases, and services provided by Kai Yep ("Artist," "I," "me," or "my"). By accessing this website, requesting a commission, or purchasing artwork, you agree to these Terms & Conditions.

If you do not agree with these terms, please do not use this website or engage my services.

Commission Process

Every icon and liturgical artwork is prayerfully created as an original work of sacred art. Because each commission is individually designed and painted, commissions require careful planning, preparation, and communication between the Artist and the patron.

A commission is considered accepted once the subject, size, materials, timeline, and price have been mutually agreed upon and the required deposit has been received.

Deposits & Payment

A non-refundable deposit is required before work begins on any commission. Payment in full may also be made at the time the commission is accepted.

All deposits are non-refundable. The deposit compensates the Artist for design work, preparation, scheduling, material acquisition, and the reservation of studio time.

The remaining balance is due immediately upon completion of the commission and must be paid in full before the artwork is shipped or delivered.

If the final payment is not received within thirty (30) days of notification that the commission is complete, the Artist reserves the right to cancel the sale, retain the deposit, and offer the artwork for sale elsewhere.

Unless otherwise agreed in writing, all prices are quoted in U.S. Dollars.

Changes to a Commission

Minor adjustments may be possible during the early stages of a commission.

Once painting has begun, substantial changes to the design, subject matter, inscriptions, dimensions, or materials may not be possible or may require additional fees and additional completion time.

The Artist reserves the right to decline requested alterations that would compromise the artistic, liturgical, or theological integrity of the work.

Completion Times

Estimated completion dates are provided in good faith but are not guaranteed.

Because every icon is created by hand and often involves multiple traditional painting and drying stages, completion times may vary. Delays caused by illness, family emergencies, supply shortages, shipping interruptions, or other circumstances beyond the Artist's reasonable control shall not constitute a breach of contract.

Patrons will be informed of any significant delays whenever possible.

Shipping & Delivery

Shipping costs, insurance, customs duties, taxes, and import fees (where applicable) are the responsibility of the purchaser unless otherwise agreed.

Risk of loss transfers to the purchaser once the artwork has been delivered to the shipping carrier.

The Artist carefully packages all artwork but is not responsible for delays or damage caused by shipping carriers. Any claims for shipping damage should be made promptly to the carrier.

Local pickup may be arranged by mutual agreement.

Copyright & Reproduction

All artwork, including commissioned works, preliminary sketches, photographs, website images, and designs, remains the intellectual property and copyrighted work of Kai Yep unless otherwise agreed in writing.

The Artist reserves all rights to reproduce, publish, print, exhibit, photograph, license, or otherwise use images of any original artwork for portfolios, exhibitions, publications, educational materials, social media, promotional purposes, and future reproductions.

The purchaser acquires ownership of the physical artwork only.

Patrons are welcome to photograph or make copies of commissioned icons for their own personal, devotional, educational, or parish use, provided the images are not sold or used for commercial advertising or merchandise.

Artwork may not be reproduced, published, licensed, sold, used in commercial products, promotional materials, or distributed for commercial purposes without the Artist's prior written permission.

Artistic Style

By commissioning an icon or liturgical artwork, the patron acknowledges familiarity with the Artist's style and previous work.

While every effort is made to fulfill the agreed design, each icon is an original hand-painted work and naturally includes individual artistic variation. No two works will be identical.

Care of Artwork

Traditional icons are intended to endure for generations when properly cared for.

Artwork should be protected from excessive moisture, direct sunlight, rapid temperature changes, and physical abuse.

Damage resulting from improper handling, accidents, environmental conditions, or neglect is not the responsibility of the Artist.

Returns & Refunds

Because commissioned artwork is created specifically for an individual patron, completed commissions are not eligible for return or refund except in cases required by applicable law.

If artwork arrives damaged during shipping, the purchaser should notify the Artist promptly and retain all packaging materials to assist with any shipping claim.

All text, photographs, graphics, logos, and artwork displayed on this website are protected by copyright and other intellectual property laws.

No content from this website may be copied, reproduced, distributed, modified, or used without prior written permission, except where permitted by law.

Limitation of Liability

To the fullest extent permitted under applicable law, the Artist shall not be liable for indirect, incidental, consequential, or special damages arising from the use of this website, commissioned artwork, or purchased goods.

The Artist's total liability for any claim shall not exceed the amount paid by the purchaser for the specific artwork giving rise to the claim.

Governing Law

These Terms & Conditions shall be governed by and interpreted according to the laws of the State of Ohio, without regard to its conflict of law principles.

Any legal dispute arising under these Terms shall be brought in the appropriate state or federal court located in Ohio.

Changes to These Terms

These Terms & Conditions may be updated from time to time without prior notice. The version published on this website shall govern all future transactions from the date of publication.
